1. Acceptance of Terms

By downloading, accessing, or using the Native Dukan and Native Dukan Partner mobile applications ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Platform Role & Limitations

Native Dukan operates strictly as an intermediary technology platform. We do not own, sell, or manage the inventory, nor do we fulfill the deliveries natively.

• We facilitate the connection between Buyers requesting products and local Shop Owners (Partners) offering those products.
• The actual contract for sale is directly between the Buyer and the Partner.
• Native Dukan is not responsible for the quality, safety, legality, or exactness of the items provided by the Partners.

3. User Accounts & Responsibilities

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you suspect any security breaches related to your account.
• Be at least 18 years of age (or the age of legal majority in your jurisdiction) to form a binding contract.

4. Terms for Buyers

Buyers may use the App to post requests for goods. By accepting an offer from a Partner, you agree to the price, delivery method (store visit or home delivery), and terms provided by that Partner. You agree not to submit fraudulent, fake, or illegal requests.

5. Terms for Partners (Shop Owners)

Partners using the Native Dukan Partner app agree to:

• Provide accurate pricing, availability, and alternative product descriptions when submitting an offer.
• Honor the offers accepted by the Buyer regarding price and fulfillment.
• Not sell prohibited, illegal, counterfeit, or strictly regulated items (e.g., unauthorized pharmaceuticals, weapons, illicit substances) through the platform.
• Comply with all local retail, taxation, and business laws applicable in their jurisdiction.

6. Prohibited Activities

Users of the Native Dukan platform shall not:

• Use the platform for any illegal or unauthorized purpose.
• Harass, abuse, or harm another person, including Native Dukan staff and local Partners.
• Attempt to bypass the platform to avoid app fees or manipulate the rating and offer system.
• Interfere with or disrupt the security, networks, or servers connected to the App.

7. Intellectual Property Rights

All content, trademarks, logos, app design, and software associated with Native Dukan are the exclusive property of Native Dukan. You may not copy, modify, distribute, or reverse-engineer any part of the App without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Native Dukan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or use of (or inability to use) the platform, or any conduct or content of any third party (including Partners) on the platform.

9. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms & Conditions. Upon termination, your right to use the App will cease immediately.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page or via in-app notifications. Your continued use of the App following any changes constitutes acceptance of those changes.
